Keep It Legal
Common sense is not a good enough rule of thumb for keeping hiring legal. All hiring managers must have a basic understanding of the legalities of hiring. Some of the legal issues are probably not as straightforward as they seem. This applies not only to those making the FINAL decision, but also to every single person interviewing a job candidate. Employers are prohibited from discriminating against job candidates on the basis of race, color, national origin, religion, sex, physical handicap or age.
Job interview questions should focus specifically on the applicant’s ability to successfully perform the duties inherent to the position.
Remember, a business owner is responsible for all the hiring practices of all the managers. Make sure that everyone involved understands the law. Don’t ask illegal questions during the interview and give full and fair consideration to all candidates!
